How to Get an H-1 B visa?
Receiving an H-1B visa can be a tedious task, however, through simplified step-wise classification, one can easily go about this process with much ease and comfort. The steps that are required to get the initial electronic registration are the following:
Create a myUSCIS account and pay the filing fee
The employer must create a representative/registrant account on the USCIS website, which differs depending on who is submitting the registration. For example, US employers and agents will use the registrant’s account.
Start the registration process
A petitioner seeking to hire H-1B employees must finish the electronic registration process by providing general information about the employer and the beneficiary. Submission of form I-129
The next step is to submit Form I-129, a petition for nonimmigrant workers. In this, the petitioner need to fill details such as the H visa Classification Supplement, the H-1B Data Collection, and Filing Fee Exemption Supplement in accordance with the form instructions along with selection notice and passport of the beneficiary.
It is filed with the LCA along with other documents, including the beneficiary’s final transcript, a letter from the registrar confirming the beneficiary has met the required degree qualification, certificates, membership documents, and educational documents, such as a resume or letter of employment.
At this stage, you also have the option of premium processing for the expedition of form I-129 with an additional fee.
Here, the requested H-1B worker has two options depending on his current location.
- If they are in the US, they need to request a change of status and wait for the H1B status to become active.
- If they are outside the US, the employee needs to file form DS-160, an online non-immigrant visa application used for entering the US on a temporary basis.
Notice of action
The petitioner will receive Form I-797 confirming the receipt and approval of the H-1B classification, including details like beneficiary name, petitioner name, and address of the service center that has the petition. After DS-160, you will need to schedule an interview at the US consulate/local embassy. In this interview, applicants are required to convince the officer with their answers to questions concerning their employment, work history, qualifications, previous US entry applications, health issues, criminal histories, etc. You must also carry important paperwork, such as a valid passport, and all the relevant petition documentation, such as the completed Form DS 160, the approved I-129, etc.
